The Madras High Court has ordered the practitioners of Indian system of medicines, such as Ayurveda, Unani and Siddha, should not practice allopath, and there is nothing wrong if police take action against those who attempt to practice it without valid qualifications.

Justice K K Sasidharan, refusing to restrain police from initiating criminal proceedings against Unani practitioners who prescribed allopathic medicines, said: "There is no dispute that Ayurveda, Siddha, Unanni, allopathy and homeopathic system of medicines have got their own history, heritage, advantages and importance...The problem would arise only when they attempt to practice the allopathic system of medicine without a degree and training".

Justice Sasidharan was passing orders on the writ petitions of K Abdul Muneer and Jalees Ahmed Siddiqi, who contended that the five-and half-year Bachelor of Unani Medicine and Surgery Course comprised a six-month alopathy training, where they got enough training to treat emergency patients with allopathy medicines.

Claiming that the police harassed Unani practitioners who prescribed allopathy medicines and they wanted the court to restrain police from interfering with their work.

The Director of Medical and Rural Health Services(DPHS), however, filed a counter, saying the syllabus of Unani and MBBS is not similar and that persons who did not have MB BS qualification cannot be registered with the Indian Medical Council(IMC) Act. Unani practitioners' prescription under allopathy stream would amount to illegal practice and they are liable for legal action, he said.

Justice Sasidharan, said, "The training given to Unani practitioners is not for the purpose of practicing in allopathic medicine or to administer modern medicine". The judge also directed the police not to harass genuine traditional Indian medical practitioners.

CHENNAI: The Madras high court has said registered practitioners in siddha, ayurveda, homeopathy and unani are eligible to practise surgery, obstetrics and gynaecology, anaesthesiology, ENT, ophthalmology, etc.

Justice F M Ibrahim Kalifulla, passing orders on a contempt of court petition filed by the Tamil Nadu Siddha Medical Graduates Association, also said penal action against such practitioners who dabbled in allopathy should be "dropped forthwith."

The ruling runs contrary to a recent order delivered by another judge on a petition filed by two unani practitioners who sought similar relief. In February this year, Justice K K Sasidharan had held that practitioners of Indian system of medicines should not practise allopathy, and that there was nothing wrong if police take action against those who attempt to practice allopathy without valid qualification.

While passing orders on Thursday, Justice Kalifulla took note of a June 29 circular of the government, which, citing section 17(3)B of the Indian Medicine Central Council Act 1970, said institutionally qualified practitioners of siddha, ayurveda, unani and homeopathy are eligible to practise the respective system with modern scientific medicine "including surgery and obstetrics and gynaecology, anaesthesiology, ENT, etc. based on the training and teaching."

The government's latest stand on the issue smacks of ambiguity while dealing with alternative systems of medicine which it seeks to promote even while claiming to check illegal practitioners. The recent crackdown had seen several traditional practioners being booked for prescribing allopathic drugs.

Near about 67 percent of homoeopaths [qualified] are practicing in rural areas of Maharashtra. They are all the first soldiers to fight diseases and various emergencies. They must have right to practice conventional medicine in emergencies. In rural areas 45 percent cases are emergencies. Homoeopathic medicines are so large in number that one can not store all of them.

i am very worried such a initiative was given by the govt. now every one of the alternative medical practitioner who have no respect and love for their own system and who lamely and shamelessly practice allopathy, will take this loophole as their sole reason and enjoy doing more and more harm to the alternative medical systems.

The IMA clearly states only in need of emergency. and emergency is a relative term which gives all opportunity to be mis-used, and taken advantage of. Many emergencies can be very well met out with alternative medicines, and only in unavoidable rare situations using of allopathic means are needed.

This step is a great setback to all alternative medicines and a shameful act on the part of Homeopathy.

All systems of medicines are developed according to requsit of pts. here i want to say that proper education of surgury is must for every practitioner .Any how, we must treat our pts in various emergencies. If a homoeopath is doing surgury what is shameful in it. As their is no medicine for local anasthesia in homoeopathy then what should be done? How you are going to tackle a case of obstructed labour?
Please understand here Homoeopathy is not on backfoot . Surgury is a special branch of medical field.
In post operative cases Homoeopathy acts well.In pre operative cases it is helpful.
Without help of modern medicine we can not do surgury.[whether it is simple or difficult]
For example we are not able to stitch without L.A.
And while serving our pts in emergency Homoeopath
In India our country is developing fast and here in this all Homoeopaths who are educated in surgury must give advantage of their knowledge tgo their pts.
Homoeopathy is a system medicine. This system has great tradition and so no one can harm Homoeopathy.

Dear Dr.D.A SATHE,
Nice to read your comments but i think Dr.Prema is right to say that this might be a an excuse rather escape for practitioners who are not well trained and hence a threatening time for Homoeopathy. I would like to mention Hahnemanne, as, when a few Homoeopaths asked for Hanhnemanne's permission for the usage of allopathic drugs in case of emergency. And Hahnemanne called them "Mongrel Sects".
In my view, its the time to enter a really great branch of medical science that is Surgery. The need is to evaluate the recent measures of Surgery and evaluate in a sense whether what measures are typically allopathic and what measures fall under the realm of homoeopathy. As its quite evident that modern western medicine is not entirely allopathic. Its allopathic in its certain aspects. The need is to incorporate homoeopathic medicines in surgery, keeping in view the golden rules of homoeopathy and avoiding the drugs which are destructive for human economy according to homoeopathic approach. We must keep in mind that we are against the rule of allopathy and anything which is not truly allopathic, so far as the treatment is concerned, may be used along with homoeopathic remedies.

Surgery is a separate branch of medical science. It has no link either with allopathy or homeopathy or any other system. The problem is that ALLOPATHS were doing surgery that's why allopathy has taken credit of surgeons work who some time takes good initiative to manage the case through surgery.

All cases are not required homeopathic medicines. All cases are also not required allopathic medicines. Sometime surgery is highly recommended to safe the life of patient. But at that stage homeopaths are not trained to manage it. The cases are referred to surgeons and allopathy then takes credit of that management. ONLY SURGERY HAS GIVEN LIFE TO ALLOPATHY TODAY.

If well educated, highly sound academically homeopaths are given training in surgery to manage surgery cases then it will boost homeopathy as well. BUT I SEE IN NEXT 20 YEARS IT IS NOT POSSIBLE AS TO MY EXPERIENCE AND KNOWLEDGE HOMEOPATHY OR HOMEOPATHIC MEDICINES DOES NOT PROVIDE THE SOLOUTION OF SO MANY AFTER SURGERY MANAGEMENT. The need of the today is to establish a research center where work is carried out to make plan how to manage each and every kind of surgery cases with homeopathic medicines.

In Pakistan, it is not possible till you bring changes in Homeopathic Practitioners Act 1965 – 2002 where is clearly and boldly written “HOMEOPATHS ARE NOT ALLOWED PERFORM SURGERY”

As for as Indian High Court decision is concerned and the way this news is circulated. I see, homeopaths are happy by this decision. This also shows that Homeopaths’s eye is more on economical aspect then homeopathic principal. The Homeopaths of India are thinking now they can more perform MORE MIXOPATHY then they are doing now. Do you know in India, above 60% homeopaths are doing mixopathy. To them it is more encouraging news. :)
